The Role of the Employer’s Agent

The employer's agent now plays a key role in contemporary construction, especially for projects procured under JCT Design and Build contracts. In this setup, the contractor is engaged to undertake both the design and the construction of the works. The employer thus requires a professional agent to represent them to verify that the contractor completes the project in conformity with the employer's requirements, the contract terms, and the agreed programme and cost plan.

Our involvement starts with assisting the client in preparing a clear and comprehensive project brief. We then proceed to conduct the tender process, advise on contractor appointment, and manage the implementation of the build contract. Once work commences on site, we continue our involvement throughout the construction period, controlling contractor performance, issuing instructions, and undertaking formal contract administration roles. These comprise the evaluation of payment applications, issuing payment notices, and tracking changes to guarantee that any variations are effectively controlled both in time and cost management.

In this capacity, we also serve as the lead consultant, managing inputs from design consultants, quantity surveyors, planning teams, and other professional advisers. Managing the Construction Phase

When practical completion is established, we go on to deal with the latter stages of the project, encompassing the preparation and agreement of the final account. We also handle post-completion issues, for example, handover documentation, commissioning records, and aftercare arrangements. By keeping close control until the project is completed in full, we provide our clients with the assurance that all contractual, legal, and commercial obligations have been duly fulfilled.
