Schedule of Condition
Our client, Bunzl, had provisionally agreed to take a lease of 120,000ft2 distribution centre in the Midlands and instructed AG to prepare a Pre-Acquisition survey and a Schedule of Condition.
Our client asked us to review the landlord’s proposals and we noted that the 10-year guarantee for the roof coating would be due to expire around the same time as our clients lease and we therefore advised that they should negotiate out of the lease any liability whatsoever for reapplying a roof coating, as in our experience, these can sometimes fall under an express redecoration covenant regardless of their condition. This was successfully incorporated into the lease reducing our client’s potential liability significantly.
It was also agreed that our client would have no liability for repainting the portal steelwork frame of the building again reducing our clients lease end liability greatly.
We undertook a detailed Schedule of Condition, with commentary, cross referenced to photographs and a reference plan and also full video recording of the unit. We also returned to the unit following the landlords works and updated our Schedule of Condition accordingly.
